Welcome to AF.CRBN. These Online Store Terms and Conditions (“Terms”) define the rules for using the online store operated by AF.CRBN Filip Ambroży, VAT: 5223367846, REGON: 544257930 (hereinafter referred to as “AF.CRBN” or the “Seller”), including rules regarding placing orders, entering into sales agreements, order fulfilment, and using the available store features.

By accessing the AF.CRBN online store or placing an order, you agree to these Terms, the Privacy Policy, and any other policies or documents referenced on the website.

If you do not accept these Terms, you may not use the online store or place orders through AF.CRBN.

Product prices and availability may change without prior notice. Such changes do not affect orders that have already been accepted for fulfilment.

AF.CRBN reserves the right to modify, suspend, or discontinue any product or service at any time.

Products may be subject to quantity limitations or regional availability restrictions.

4a – Product Purpose and Compatibility

Products offered by AF.CRBN may be intended for automotive, performance, tuning, motorsport, or track-use applications, depending on their specifications and the information provided for each product.

The customer is responsible for ensuring that the selected product is suitable for their vehicle, including compatibility with the vehicle model, production year, equipment version, and intended use.

AF.CRBN makes reasonable efforts to ensure that product descriptions, technical specifications, and compatibility information are accurate and current. If there is any uncertainty regarding product compatibility, customers are encouraged to contact AF.CRBN before placing an order.

The customer must ensure that installation and use of purchased components comply with the intended purpose of the product and applicable legal requirements.

4b – Product Installation and Use

Some products offered by AF.CRBN may require professional installation, specialist tools, or technical knowledge.

AF.CRBN recommends that installation of components affecting vehicle aerodynamics, safety, or structural elements is performed by qualified professionals or specialised workshops.

AF.CRBN shall not be liable for damage to products, vehicles, or other components resulting from improper installation, misuse, use contrary to the product’s intended purpose, or failure to follow installation instructions, without limiting any mandatory consumer rights and statutory liability under applicable law.

4c – Road Approval and Intended Use

Not all products offered by AF.CRBN have road approval, homologation, or authorisation for use on public roads.

Information regarding the intended use of a specific product, including whether it is designed for road, performance, motorsport, or track applications, is provided in the product description or technical specifications.

Before purchasing, the customer is responsible for ensuring that the selected product complies with the legal requirements applicable in the country where the vehicle is used.

The absence of road approval or public-road authorisation, where such information has been clearly provided before purchase, does not constitute a product defect.

5 – Orders, Payments and Billing Information

When placing an order, you must provide accurate contact and billing information.

AF.CRBN may refuse to process or cancel an order only where permitted by applicable law or due to justified circumstances, including incorrect customer information, an obvious pricing error, product unavailability, or a reasonable suspicion of fraudulent activity.

Consumers will be informed of the reason for refusal or cancellation where required by applicable law.

Payments are processed through payment service providers that apply security requirements appropriate for payment services.

5a – Formation of the Sales Contract

  • Product information displayed on the website constitutes an invitation to submit an offer to purchase and does not itself constitute a binding sales offer.

  • By placing an order, the customer submits an offer to enter into a sales agreement.

  • After receiving an order, AF.CRBN sends an electronic confirmation acknowledging receipt of the order.

  • The sales contract is concluded when AF.CRBN confirms acceptance of the order for fulfilment and sends confirmation of the contract to the customer electronically.

  • Confirmation of the concluded contract and its terms is provided to the customer on a durable medium, including by email.

5b – Pre-order Products

AF.CRBN may offer selected products as pre-orders, meaning that the product is ordered, prepared, or manufactured after the customer places an order.

Information regarding the pre-order status and the estimated fulfilment timeframe will be provided on the relevant product page or in order-related communication.

Estimated delivery or fulfilment dates provided for pre-order products are indicative only and may change due to circumstances beyond AF.CRBN’s reasonable control, including production processes, material availability, supplier delays, quality control procedures, or technical factors.

By placing a pre-order, the customer acknowledges and accepts that the product may be delivered at a later date than products available for immediate purchase.

6 – Shipping, Returns and Refunds

Orders are fulfilled in accordance with the Shipping Policy, Returns, Warranty Policy, and any other applicable policies available on the AF.CRBN website. These documents form an integral part of the terms applicable to purchases made through AF.CRBN.

Detailed information regarding delivery methods, shipping times, international shipments, customs duties, import charges, returns, complaints, statutory liability for lack of conformity of goods, and warranties is provided in the relevant policies available on the AF.CRBN website.

Returns, complaints, and consumer rights are handled in accordance with applicable Polish law and European Union consumer protection regulations.

The customer is responsible for providing accurate delivery information.

7 – Optional Features and Third-Party Services

Use of third-party services is subject to the terms and conditions of those providers. AF.CRBN is not responsible for interruptions, errors, or failures caused by independent third-party services, without limiting any mandatory rights and obligations under applicable law.

AF.CRBN is not responsible for the content, privacy practices, security, or policies of external websites.

Any disputes, transactions, or complaints relating to third-party websites should be addressed directly to their respective operators.

Customers may provide reviews, comments, photographs, or other content voluntarily in connection with their use of the AF.CRBN store.

By submitting such content, the customer grants AF.CRBN a non-exclusive, royalty-free licence to use and display this content for purposes related to operating the store, presenting products, and publishing customer reviews.

  • violate applicable laws;

  • infringe third-party rights;

  • contain misleading information;

  • include unlawful, offensive, defamatory, or harmful material.

The collection and processing of personal data are carried out in accordance with our Privacy Policy, the General Data Protection Regulation (GDPR) where applicable, the UK GDPR, and applicable data protection laws.

13 – Liability and Limitation of Liability

However, AF.CRBN cannot guarantee uninterrupted availability of the website where interruptions result from circumstances beyond AF.CRBN’s reasonable control, including technical failures, third-party service interruptions, maintenance, or force majeure events.

Nothing in these Terms excludes or limits any mandatory consumer rights or statutory liability provided under applicable Polish law or European Union law.

The customer may stop using the services provided by AF.CRBN at any time.

AF.CRBN may restrict access to the website, suspend accounts, or terminate electronic services where justified, including in cases of violation of these Terms, applicable law, or website security requirements.

Any obligations arising before termination shall remain effective.

Serious violations of these Terms may result in immediate suspension of access.

16 – Entire Agreement

These Terms, together with the Privacy Policy, Shipping,Returns and Warranty Policy or any other referenced documents, constitute the complete agreement between the customer and AF.CRBN regarding the use of the online store and purchase of products.

17 – Governing Law and Dispute Resolution

These Terms are governed by Polish law, taking into account applicable mandatory consumer protection provisions that may apply in the country where the customer resides.

For customers located in the European Union, consumer protection rights granted under applicable EU legislation remain unaffected.

For customers located in the United Kingdom, mandatory consumer protection rights provided under applicable UK consumer protection laws remain unaffected, including rights relating to product conformity, refunds, and remedies available to consumers.

Consumers may use available out-of-court dispute resolution procedures and may bring claims before competent courts in accordance with applicable consumer protection laws.

Nothing in these Terms limits any mandatory rights granted to consumers under applicable law.

18 – Changes to These Terms

AF.CRBN may update these Terms from time to time.

Changes will not affect rights acquired by customers in connection with orders placed before the updated Terms become effective.
